As consideration for State Fair of Texas admitting me to the 2008 Fair and permitting me to display my Vehicle(s) in the Classic Car Corral (the "Event"), SFT, the City of Dallas, and the Parks and Recreation Board of the City of Dallas, Classic Chassis Car Club of Dallas, Lambda Car Club International, their respective subsidiaries and affiliated companies, agents, owners, officers, directors, employees, volunteers, participants, sponsors, and all other persons or entities acting in any capacity on their behalf (collectively the "Releasees"), I hereby agree to release and discharge Releasees on behalf of myself, my children, my parents, my heirs, assigns, personal representative and estate as follows: "I acknowledge that participating in the Event at the 2007 Fair entails known and unanticipated risks which could result in physical or emotional injury, paralysis, death, or damage to myself, to my Vehicle(s), other property, or to third parties. I understand that such risks simply cannot be eliminated without jeopardizing the essential qualities of the Event. The risks include, among other things installing the Vehicle(s) for display, maintenance on the Vehicle(s), public display of the Vehicle(s), supplied equipment failure; the negligence of other participants, visitors, patrons or other persons who may be present; musculoskeletal injuries; head injuries; or my own negligence. I expressly agree and promise to accept and assume all of the risks existing in the Event. My participation in the Event is purely voluntary, and I elect to participate in spite of the risks. "I hereby release, waive, discharge and covenant not to sue Releasees, from all liability to me, my personal representatives, assigns, heirs, and next of kin for any and all claims, losses, demands, obligations, causes of action and lawsuits (collectively "Claims") and all damages, liabilities, fines, penalties, judgments, costs and expenses associated therewith (collectively "Damages") on account of injury to the person, Vehicle(s) or property or resulting in my death arising out of or in any way related to: (1) the failure of me to comply with the terms and conditions of the Agreement; (2) the services performed or actions taken by me in connection with the Event; (3) defects in the Vehicle(s), trailers or equipment provided by me in connection with the Event; (4) my participation in the Event; or (5) the negligent, grossly negligent or intentional acts or omissions of me. "I certify that I have adequate insurance to cover any injury or Damages I may cause or suffer while participating, or else I agree to bear the costs of such injury or Damages to myself or my Vehicle(s). I further certify that I have no medical or physical conditions that could interfere with my safety in this Event, or else I am willing to assume – and bear the costs of – all risks that may be created, directly or indirectly, by any such condition.” "By clicking Accept, I acknowledge that if any one is hurt or property is damaged during my participation in the Event, I may be found by a court of law to have waived my right to maintain a lawsuit against Releasees on the basis of any Claims or Damages from which I have released them herein. I have had sufficient opportunity to read this entire document. I have read and understood it, and I agree to be bound by its terms."
